JUVENILE LAW AND PROCEDURE IN TEXAS&lt;br /&gt;&lt;br /&gt;Juvenile law and procedure in Texas is a combination of laws drawn from several areas. Juvenile cases are significantly different from adult criminal cases. It is also important to note that a juvenile case is actually a civil proceeding whereas an adult criminal defendant is charged in a criminal proceeding. Juvenile law is a hybrid of civil and criminal law. While the actual charges against a juvenile are brought by means of a civil lawsuit, the juvenile offender is given virtually the same constitutional rights, privileges and protections that an adult criminal defendant possesses. The juvenile system has its own set of terminology and processes that differ drastically from its adult counterpart.&lt;br /&gt;&lt;br /&gt;The original Title III of the Texas Family Code was written in 1973 and has been amended numerous times over the years. The single most significant revision to juvenile law and procedure came in 1995 during the 74th Texas Legislature where juvenile justice reform was a major issue. Voluminous changes in the juvenile justice system resulted, most of those dealing specifically with violent and habitual juvenile offenders.&lt;br /&gt;&lt;br /&gt;A. Introduction. Texas juvenile law is governed primarily by Title III of the Texas Family Code entitled the "Juvenile Justice Code". The main goals of the juvenile justice system in Texas, as mandated by TEX. FAM. The Court held that the proceedings for juveniles had to comply with the requirements of the Fourteenth Amendment. These requirements included adequate notice of charges, notification of both the parents and the child of the juvenile's right to counsel, opportunity for confrontation and cross-examination at the hearings, and adequate safeguards against self-incrimination. Detention Hearing. If a child is taken into custody, juvenile court intake (usually the juvenile probation department) initially determines if the person meets the definition of "child" discussed above and whether probable cause exists to believe the child engaged in the offense. Intake then makes a determination on whether a child should be detained or not. The Texas Family Code has a built-in presumption in favor of releasing the child to a suitable parent or guardian. At least one of five statutory criteria to detain must be present. These five criteria are: (1) the child is likely to abscond or be removed from the jurisdiction of the court, (2) suitable supervision, care or protection for the child is not being provided by a parent, guardian, custodian, or other person, (3) the child has no parent, guardian, custodian, or other person able to return him to the court when required, (4) the child may be dangerous to himself or he may threaten the safety of the public if released, or (5) the child has previously been found to be a delinquent child or has previously been convicted of a penal offense punishable by a term in jail or prison and is likely to commit an offense if released. TEX. FAM. CODE ANN. Section 54.01.&lt;br /&gt;If a child is detained by intake then a judge must make a finding of probable cause within 48 hours and hold a detention hearing within one or two working days. The court uses the same criteria as intake in deciding whether to detain a child. Detention hearings must then be held every 10 working days thereafter. She was promoted to replace Fernando Gomez who resigned.&lt;br /&gt;&lt;br /&gt;Blanchard, a Brownsville native and Ortiz' long-time Director of District Operations, has worked for Ortiz for more than 16 years. Her experience includes constituent services, district office operations, and a political understanding of South Texas. She began service with Ortiz in 1991, becoming District Director in 1995. Previously, she worked with the Brownsville Chamber of Commerce, the Brownsville Economic Development Council and the Brownsville-South Padre Island International Airport.&lt;br /&gt;&lt;br /&gt;This is Ortiz's second staff resignation in two months.&lt;br /&gt;&lt;br /&gt;Ortiz’s long-time communications director, Cathy Travis, resigned Dec. 31 to continue her writing career. Ortiz hired Dallas-native Danny Guerra, 25, to replace Travis. Guerra wrote previously for political news magazine Congressional Quarterly. According to &lt;a href="http://www.brownsvilleherald.com/news/guerra_82442___article.html/texas_ortiz.html"&gt;&lt;em&gt;The Brownsville Herald&lt;/em&gt;,&lt;/a&gt; he also worked previously with several Texas legislators.&lt;br /&gt;&lt;br /&gt;&lt;span style="font-weight: bold;font-family:verdana,helvetica,arial;" &gt; And Let us Not Forget &lt;/span&gt;&lt;br /&gt;&lt;br /&gt;&lt;a href="http://www.brownsvilleherald.com/ts_more.php?id=70491_0_10_0_C"&gt;Representative Ortiz&lt;/a&gt; to replace his long-time chief of staff, 'Lencho' Rendon with 'Nando' Gomez.&lt;blockquote&gt;Ortiz, D-Corpus Christi, also announced the promotion of Denise Blanchard, director of district operations to deputy chief of staff, the post Gomez held.&lt;br /&gt;&lt;br /&gt;Ortiz said that Gomez, “is very level-headed. He is not the type that gets angry. He always looks at the issue before he makes a decision and he always counsels with the staff.”&lt;br /&gt;&lt;br /&gt;Ortiz said Gomez of Gregory worked in Washington, D.C., for eight years as legislative director for former U.S. Rep. Martin Frost, as Ortiz’s legislative director in 2005, followed by promotion to deputy chief of staff. Ortiz said Gomez handles military matters. &lt;br /&gt;Nueces County Republicans say they have a shot at electing the first Republican to the Texas House District 33 seat because of strong candidates for the nomination and a split in the Democratic Party over its nominee.&lt;br /&gt;&lt;br /&gt;Former Nueces County Commissioner Joe McComb and local certified public accountant Raul Torres notified Republican Party Chairman Mike Bertuzzi that they want to be considered for the seat, vacated when longtime state Rep. Vilma Luna announced her resignation last month.&lt;br /&gt;&lt;br /&gt;Luna was unopposed in the March primary election, but her resignation means precinct chairs from each party get to nominate someone to appear on the Nov. 7 ballot.&lt;br /&gt;&lt;br /&gt;Republican precinct chairs will meet Tuesday night to determine their party's nomination, Bertuzzi said.&lt;br /&gt;&lt;br /&gt;With the Democrats fighting over who will get their nomination, and the acrimony that decision is likely to create, it leaves an opening for a Republican to get into 33, which always has been held by the Democrats, Bertuzzi said.&lt;br /&gt;&lt;br /&gt;"I think we have everybody in the same boat rowing in the same direction," Bertuzzi said.&lt;br /&gt;&lt;br /&gt;"Does their fight help? It has to. Whoever our candidate ends up being, they should be able to mount a good campaign."&lt;br /&gt;&lt;br /&gt;McComb, 59, a lifelong Republican ran for state representative in the 1970s against incumbent L. Dewitt Hale and lost by a percentage point. He went on to serve as a Corpus Christi city councilman for eight years before winning the Precinct 4 Nueces County commissioner seat in 1994, where he served another eight years.&lt;br /&gt;&lt;br /&gt;"I think they need somebody up there who has experience at the city and county level and somebody who has some business experience that is also committed to this community," McComb said.&lt;br /&gt;&lt;br /&gt;Torres, 51, is a local certified public accountant who has not held public office but ran for the Corpus Christi Independent School District Board and Nueces County clerk in 2004.&lt;br /&gt;&lt;br /&gt;He said he wanted to run against Luna in 2004, but was told that she was so popular that she could not be beaten.&lt;br /&gt;&lt;br /&gt;"It's a policy-making position I really have an interest in," Torres said. And according to a published report, Texans for Taxpayer Relief will be “funded at least in part with corporate money.” And when asked to defend the planned use of corporate money, Perry’s state spokeswoman said, "The tobacco companies are using corporate money to attack the tax bill" (Texas Weekly, Volume 22, Issue 41, Apr. 17, 2006). In short, corporate funds appear to be funding ads to further an officeholder activity of Governor Perry, raising serious legal issues.&lt;br /&gt;&lt;br /&gt;    The ads also may be an illegal corporate contribution because they appear coordinated with Governor Perry. The law appears clear that corporate-funded ads, even clearly those that are issue ads, are considered electioneering or officeholder activity if coordinated with a candidate or officeholder. Rick Perry’s personal involvement with this ad campaign appears to belie any claim that Texans for Taxpayer Relief’s ads operate independently from his official duties as Texas Governor....&lt;br /&gt;&lt;br /&gt;    Check out the letter here.&lt;br /&gt;&lt;br /&gt;    You figure after the corruption scandals dealing directly with corporate contributions (Texan for Republican Majority (TRMPAC), Texas Association of Business (TAB) and Tom Delay and Co.), you would think they would leave well enough alone. It is almost like they want to go to jail.&lt;br /&gt;&lt;br /&gt;    Getting directly to the point, Bell states “After four years of fighting the effects of corporate money in Texas politics, I am greatly disturbed that Rick Perry is raising unlimited corporate donations from the very same businesses that will benefit from his plan. This is exactly what I’m talking about when I say Rick Perry is taking ethics lessons from Tom DeLay.”&lt;br /&gt;&lt;br /&gt;    Ronnie Earle once said: "The reason corporations and labor unions are not allowed to give money to campaigns is because they are not individual people. They are things. And to allow things to control elections makes a mockery of government by the people.... I asked for his support of the Fair Tax, and the other time I asked for his support of some Credit Union legislation. Both times I received a reply, most likely from an automated response generated by his staffers. Either way, I still received a response and that''s all you can ask for. &lt;br /&gt;&lt;br /&gt;I''ve lobbied with the Associated Builders and Contractors once, and do very small-scale lobbying locally when necessary. I was fairly ticked about the border situation. A month later I got a response. This is, I''m told, normal. &lt;br /&gt;&lt;br /&gt;I did get a letter from Rick Perry, formatted of course about that told me all the wonderful things he plans to do. &lt;br /&gt;&lt;br /&gt;Ortiz sent me an email. If you like I will forward to you what he sent. &lt;br /&gt;&lt;br /&gt;The Senators did the same thing. &lt;br /&gt;&lt;br /&gt;The exception was Gene Seaman, to be honest I sent him a blast and got a response the same day from his staff. I was able to hammer things out but my perception of Seaman made a 180. I''m voting for him. I''ve stated before that America has the best politicians money can buy. I still believe that a voter has power for the few months before the politician is elected and special interest gets the rest. Hinojosa and I think Senator Kay Bailey Hutchison on the FairTax. &lt;br /&gt;&lt;br /&gt;On Hinojosa''s website, it does say that he responds only by snail mail, so I''ll give him a bit longer. Hutchinson has the whole state to worry about, so I can understand some delay in her response also. &lt;br /&gt;&lt;br /&gt;As far as Toureilles, this is the third time I have emailed her and only received one response. He was tardy too many times during the middle of the day. First of all my child is on time to school. I get him there and pick him up. I employ due diligence and keep in touch with his education. I was never informed of the tardy problem until I recieved a letter from the court. Gary Ganschow thwarted every reqirement of an attendance officer. He never contacted me and still to this day I have never spoken with the CCISD ramrod. I am sure he has done a lot of good for many but not in this case. Anyway, my wife was charged along with my son for contributing to his tardies even though they occurred in the middle of the day. I am disgusted with CCISD and they will now feel the byte as Suzie Luna is connected with this blatant singling out of my children. WOW! I never beleived that CCISD would stoop this low as to distress my children for my work as a writer. Well it is now evident this is going on.&lt;br /&gt;&lt;br /&gt;So on with the story. I requested a jury trial and subpoenaed witnesses. They showed up to the Precinct 2 Place 2 Court in Flour Bluff. Without the states prosecutor all progress waited for Michelle's arrival. We waited for over an hour and still no show of Michelle. Finally Judge Cox came out and announced "the state has not met their burden" he went on to say, "if any of you would have been 45 minutes late I would be issuing a warrant". Then to everyones astonishment he said, "I am going to dismiss all or your cases". There was approximately 15-25 cases in that room including David Bonilla and one of his young female employees. David you had a ring on your finger. Somebody needs to tell your wife to remind you about sexual harassment in the work place. It is not worth it to mingle with the help. Try to elevate the attractive but there was no brains.&lt;br /&gt;&lt;br /&gt;If it was Judge JAG he would have never dismissed the cases he would have told to come back and reset the date. Now that is what I call a crook.
